Terms of Sale.

These Terms of Sale (the “Terms”) govern every purchase of physical hardware (such as the GrapheneOS Pixel 6a and Tails OS ThinkPad T470) and digital goods (such as preloaded operating systems, configuration profiles, and printed materials) made through arkadiaanalytics.com or its successor sites (collectively, the “Shop”).

By placing an order through the Shop and ticking the “I agree to the Terms of Sale” box at checkout, you agree to these Terms. If you do not agree, do not place the order.

The hardware we sell is refurbished unless the listing explicitly says otherwise. Each device is inspected, wiped, reflashed, and tested before shipment, and rated to the condition disclosed on the listing (e.g. “grade A,” “battery health ≥85%,” “cycles <500”).

Refurbished hardware will show normal cosmetic wear consistent with prior use. We disclose what we observe during inspection; we do not warrant cosmetic perfection. If a device arrives in materially worse condition than disclosed, that is a defect under section 5 and we will replace or refund.

Our hardware ships with privacy-focused operating systems (GrapheneOS, Tails) and a baseline of operator tooling: a preconfigured VPN client, encrypted DNS, and a LUKS-equivalent encrypted profile. The operating systems and bundled tools are third-party software released under their respective licenses. We do not own them; we install and configure them.

You agree to use this software in accordance with its license terms and applicable law. We make no representation that the software is suitable for any particular legal context or threat model — that judgment is yours.

Prices are listed in U.S. dollars and shown at checkout before you confirm payment. Sales tax is calculated based on shipping address and applied where required by law. Payment is processed by Stripe, Inc.; we do not see or store your card details.

We may change prices at any time, but a confirmed order locks in the price you saw at the moment of checkout.

We warrant that your device will function as described for 30 days from delivery. If during that window the device fails due to a manufacturing defect or our refurbishment error, contact us at info@arkadiaanalytics.com and we will, at our option, repair, replace, or refund.

This warranty does not cover damage from drops, spills, water exposure, modification, or installation of additional software outside our preloaded baseline. Battery capacity is covered only if it deviates materially from the disclosed condition at delivery; gradual battery wear over time is normal use, not a defect.

Beyond this 30-day defect warranty, hardware is sold “as is” with no further express or implied warranties, including no implied warranty of merchantability or fitness for a particular purpose.

Orders ship within the timeframe disclosed on each product listing (typically 5 business days). We ship insured to the address you provide at checkout. Risk of loss transfers to you upon delivery to the carrier; if a package is lost or damaged in transit, we will work with you and the carrier to resolve the claim.

Because each device is wiped, reflashed, and configured individually for the purchaser, we accept returns only:

• Within the 30-day defect warranty above, or
• Within 14 days of delivery if the device is unopened, sealed, and accompanied by the original packaging, in which case we will refund the purchase price minus a 10% restocking fee.

Refunds are issued to the original payment method via Stripe and typically post within 5-10 business days.

The privacy-focused operating systems and tooling we preload are dual-use: they protect against unlawful surveillance and commercial tracking, and they can also be misused. You represent that you will not use the device or preloaded software to commit, attempt, or facilitate any crime against another person or system.

We do not monitor what you do with the device after it leaves our facility. We do not retain device-specific keys, passphrases, or recovery information after handoff.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to a sale is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost data, lost revenue, or downtime.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

We collect the information needed to fulfill your order — name, shipping address, contact email, payment-processor token. Our full handling practices are described in our Privacy Notice. We do not sell or share your personal information with third parties for marketing.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules. Disputes arising out of or relating to a sale will be resolved in the state or federal courts located in Union County, New Jersey, and you consent to their personal jurisdiction.

We may update these Terms from time to time. The Terms in effect when you place your order govern that order. The “Last revised” date at the top of this page reflects the current version.
